Simple Promise
We connect great candidates with great companies. Here's what that means legally.

1. What Qwestly Does
For Candidates: Create anonymous profiles, get matched with relevant opportunities, choose when to reveal your identity.
For Companies: Access high-quality anonymous candidate profiles through annual platform subscription.
For Everyone: We facilitate introductions. You handle everything after that.
2. Account Requirements
Candidates
• May be required to verify work email for enhanced credibility
• Must provide accurate professional information
• Anonymous profiles must reflect real experience
• One account per person
• Cannot share account credentials with others
Companies
• Must be legitimate business entities
• Must complete company verification process
• Must pay annual subscription fee before accessing candidates
• Must be transparent about conversation goals (hiring, advice-seeking, networking, etc.)
3. How Anonymous Profiles Work
Your Responsibility
• You control what goes in your anonymous profile
• Before activating your profile, you must review and verify it meets your personal comfort level for anonymity
• We help protect anonymity, but you decide what to share
• Don't include identifying information you want to keep private
Our Responsibility
• Store personal info separately from anonymous profiles
• Only reveal identity when you explicitly consent
• Companies can't see your name, current employer, or contact info unless you approve
No Guarantees
• You are required to review your profile before becoming active and confirm it meets your anonymity preferences
• We can't guarantee 100% anonymity (determined parties might figure things out)
• We're not responsible if you accidentally reveal identifying information
• Third parties might recognize your experience pattern
4. Company Access & Conversations
How Platform Access Works
• Companies pay annual subscription fees for platform access
• Payment due upfront before gaining full access to candidate profiles
• Our AI suggests relevant matches based on anonymous profiles
• Companies can express interest in candidates
• Candidates choose whether to connect
• We facilitate the introduction, you handle the rest
Conversation Transparency
• Companies must be transparent about their conversation goals
• Whether seeking to hire, get advice, network, or explore opportunities
• Candidates have the right to know what companies hope to gain from conversations
• No bait-and-switch - represent your intentions accurately
What We Don't Do
• We don't conduct interviews
• We don't verify credentials (that's your job)
• We don't guarantee candidate performance or availability
• We don't handle employment disputes or negotiations
5. User Content & Behavior
Your Content
• You own your profile information
• You're responsible for accuracy
• No false, misleading, or illegal content
• No confidential information belonging to others
Prohibited Uses
• Creating fake profiles or companies
• Sharing account credentials with others
• Attempting to reverse-engineer anonymous profiles
• Harassing other users
• Using platform for anything other than legitimate recruiting/networking
• Circumventing our privacy protections
Content Removal
• We can remove content that violates these terms
• We can suspend accounts for policy violations
• Repeated violations = permanent ban
6. Privacy & Data
What We Collect
• Professional information for matching
• Usage data to improve the platform
• Communications between users
What We Don't Do
• Sell your personal data
• Share identity information without consent
• Keep data longer than necessary
Your Rights
• Access, edit, or delete your data anytime
• Download your information
• Control who sees your profile

7. Payments & Subscriptions
Annual Subscription Fees
• Companies pay annual subscription fees for platform access
• Payment due upfront before gaining full access to candidates
• Late payments may result in account suspension
• Disputed payments must be raised within 60 days
No Refund Policy
• All subscription fees are non-refundable
• Subscriptions are annual commitments
• Account cancellation doesn't entitle you to refunds
• Platform access continues through end of paid subscription period
Payment Disputes
• Good faith efforts to resolve directly first
• Formal dispute process available
• Arbitration for unresolved disputes (see Section 10)
8. Disclaimers & Limitations
What We Promise
• Good faith effort to provide accurate matching
• Reasonable security measures for your data
• Platform availability (though outages happen)
What We Don't Promise
• Perfect matches every time
• Candidate performance after hiring
• 100% platform uptime
• Elimination of all hiring risks
Limitation of Liability
• Our maximum liability to you is the subscription fees you paid in the last 12 months
• We're not liable for indirect damages (lost profits, business interruption, etc.)
• We're not liable for user conduct or third-party actions
• Some states don't allow these limitations, so they may not apply to you
9. Intellectual Property
Our Stuff
• Qwestly platform, algorithms, and branding belong to us
• You can use our platform but can't copy our technology
• Our AI models and matching algorithms are proprietary
Your Stuff
• Your profile information belongs to you
• You grant us license to use it for platform operations
• You can delete your data and revoke this license anytime
Respect Others
• Don't copy other users' content
• Don't infringe on company trademarks in your profile
• Report intellectual property violations to legal@qwestly.com
10. Dispute Resolution
Try Direct Resolution First
• Talk to us: support@qwestly.com
• Most issues get resolved quickly with good faith discussion
• We want happy users, not legal battles
Formal Process
• Arbitration: Disputes go to binding arbitration (faster and cheaper than courts)
• Individual basis: No class action lawsuits
• Location: Arbitration in San Francisco, CA
• Exception: Either party can go to court for intellectual property disputes
11. Account Termination
You Can Leave Anytime
• Cancel your subscription to prevent future charges
• Delete your account in settings
• We'll remove your data per our retention policy
• No refunds for unused subscription time
We Can Terminate For
• Violating these terms
• Fraudulent activity
• Harassing other users
• Legal requirements
• Non-payment of subscription fees
What Happens After
• You lose access to the platform immediately
• Your data gets deleted per our privacy policy
• No refunds for remaining subscription period
12. Changes & Updates
Terms Changes
• We'll email you about significant changes
• 30-day notice before changes take effect
• Continued use means you accept new terms
• You can delete your account if you disagree
Platform Changes
• We may add, remove, or modify features
• We'll try to give advance notice for major changes
• Some changes may be immediate for security reasons
13. Legal Stuff
Governing Law
• California law governs these terms
• Federal arbitration law governs dispute resolution
Entire Agreement
• These terms + privacy policy = our complete agreement
• Supersedes any previous agreements
• Changes must be in writing
Severability
• If part of these terms is unenforceable, the rest still applies
